GRUPO ILUMINABLE S.L. is dedicated to the sale of lamp accessories, lighting components and related products to customers across the European Union.

These General Terms and Conditions of Use and Sale (the “Terms”) govern access to and use of the Website, as well as all distance sales contracts concluded between LIGHTING DIY and customers located in the European Union.

By accessing or using the Website, the user acknowledges and accepts these Terms in full, without reservation. Placing an order on the Website implies full and unconditional acceptance of these Terms.

2. Legal information and hosting

Publisher: GRUPO ILUMINABLE S.L., represented by its legal representative.

Hosting: the Website is hosted on servers located within the European Union under a hosting contract concluded by GRUPO ILUMINABLE S.L. with a professional hosting provider. Identity and contact details of the hosting provider are available to consumers upon request at support@lightingdiy.com.

Access to and use of the Website is intended for persons of legal age and with legal capacity to enter into contracts under the laws of their country of residence. The customer is responsible for ensuring that their hardware, software and internet connection are suitable for accessing the Website.

3. Website content, products and information

LIGHTING DIY uses reasonable efforts to ensure that the information on the Website is accurate and up to date, including product descriptions, technical specifications, prices and images. However, technical or human errors may occur and discrepancies may arise between photos, descriptions and prices.

Product images are for illustrative purposes only. Minor variations in colour, finish or appearance may occur, especially for handmade products or raw brass items, without affecting the essential characteristics, safety or performance of the product.

In the event of any discrepancy between the image and the written description, the written description shall prevail, provided that the essential characteristics of the product are maintained.

LIGHTING DIY is not responsible for content, information, opinions or comments provided by third parties on the Website, nor for the use that users may make of such information.

4. User obligations

Access to and use of the Website are subject to applicable law, the principles of good faith and lawful use by the user. Any action that may cause damage to LIGHTING DIY, to other users or to third parties is strictly prohibited.

The user undertakes to:

  • use the Website and its content only for lawful purposes and in accordance with these Terms;
  • refrain from copying, reproducing, distributing, transmitting, modifying or exploiting the Website or its content without prior written permission from LIGHTING DIY;
  • respect intellectual and industrial property rights and any other similar rights;
  • not circumvent or interfere with any security or technical protection measures on the Website.

5. User account and access credentials

Browsing the Website does not require prior registration. However, customers must create an account in order to place orders, track deliveries and download invoices.

When creating an account, the user chooses a username and password (“Access Credentials”). The user may not select usernames that are offensive, unlawful, infringing third-party rights (including trademarks, trade names, company names, names of public figures) or contrary to public order and good morals. LIGHTING DIY reserves the right to remove or suspend any username that violates these rules.

The user undertakes to keep the Access Credentials confidential and not to disclose them to third parties. Any loss, theft or suspected unauthorised use of the Access Credentials must be notified to LIGHTING DIY without undue delay.

Access Credentials are personal and non-transferable. Any operation carried out using the Access Credentials will be presumed to have been carried out by the account holder. LIGHTING DIY accepts no liability for damages resulting from fraudulent or negligent use of Access Credentials by the user or third parties.

6. Service availability and modifications

LIGHTING DIY may temporarily suspend access to the Website or certain services, without prior notice, when necessary for maintenance, updates or improvements.

LIGHTING DIY may modify the structure, design, content or services of the Website at any time, as well as the conditions of access, provided that such changes do not affect contracts already concluded with customers.

LIGHTING DIY may block, restrict or remove access to the Website for users who make unlawful, dishonest or abusive use of the services or who publish content that is illegal, racist, defamatory, violent, pornographic, fraudulent or contrary to applicable laws or regulations.

7. Orders and payment methods

Orders are placed exclusively via the Website. Orders only become binding once payment has been successfully authorised and confirmed.

After placing an order, the customer must pay using one of the payment methods available on the Website at the time of ordering. Currently, the accepted payment methods are:

  • credit or debit card;
  • bank transfer;
  • PayPal;
  • Bizum (where available);
  • Google Pay;
  • payment in instalments via Scalapay.

When buying with Scalapay, the customer receives the order immediately and pays in the number of instalments chosen. The customer accepts that the instalments may be assigned to Retail Instalments SPV 1 Limited, its affiliated entities and assignees, and expressly authorises such assignment.

The maximum accepted order amount is 10,000 EUR, regardless of the number of items. A minimum order value of 10 EUR (excluding VAT) in products applies.

The place of delivery is the address indicated by the customer in the checkout process. The order is considered placed on the same day if it is completed before 15:00 (Central European Time). Orders placed after 15:00 or on non-working days are considered placed on the next working day. In all cases, delivery lead times start from receipt of payment by LIGHTING DIY.

After receiving payment, LIGHTING DIY issues the corresponding invoice, which the customer can download in their user account area. Paper invoices are not sent.

LIGHTING DIY reserves the right to cancel an order and refund the amount paid if irregularities are detected in the ordering or payment process or if there are reasonable suspicions of fraud or unlawful activity.

8. Prices and Shipping Conditions

Product prices are indicated in euros (EUR) and, unless expressly stated otherwise, include Value Added Tax (VAT) at the rate applicable to the customer under EU VAT rules. The final VAT applied may vary depending on the country of delivery.

Unless expressly stated otherwise, prices do not include shipping costs, transport insurance, or additional services related to the product.

LIGHTING DIY reserves the right to modify prices at any time. Products will be charged at the price in force at the time the order is confirmed by the customer.

For shipments via PUNTO PACK / DPD Pickup, the recipient has 8 days to collect the parcel before it is returned to the sender.

If the volume or weight of the order exceeds standard shipping parameters, or if specific delivery conditions require different arrangements, LIGHTING DIY reserves the right to contact the customer to provide a customized shipping quotation adapted to the order.

9. Transport, delivery times and transfer of risk

LIGHTING DIY will make every reasonable effort to deliver orders within the estimated delivery times, which normally range between 2 and 10 working days, depending on product availability, destination country and carrier performance.

However, LIGHTING DIY cannot be held liable for delays caused by circumstances beyond its reasonable control, including delays attributable to carriers, peak seasons, strikes, severe weather or force majeure events.

Upon delivery, the customer must sign the carrier’s delivery note as confirmation of receipt. By signing without reservations, the customer acknowledges that the goods have been received in apparent good condition.

To activate transport insurance or correct any delivery errors, it is essential that the customer notes any visible damage or irregularities concerning the goods or packaging on the carrier’s delivery document (in the “observations” or similar field) and informs LIGHTING DIY in writing within a maximum of 24 hours from delivery, preferably with photographs.

If these conditions are not met, LIGHTING DIY may not be able to accept claims for damage in transit or shortages.

The risk of loss of or damage to the goods passes to the customer when the customer or a third party indicated by the customer (other than the carrier) acquires physical possession of the goods, in line with EU consumer protection rules.

LIGHTING DIY retains title to the products until full payment of the purchase price has been received.

10. Right of withdrawal (consumer right of cancellation)

In accordance with Directive 2011/83/EU on consumer rights, as implemented in the laws of the EU Member State of the consumer, consumers have the right to withdraw from distance contracts without giving any reason within 14 calendar days.

The withdrawal period expires 14 days after the day on which the consumer, or a third party other than the carrier and indicated by the consumer, acquires physical possession of the goods. If the contract covers multiple goods ordered in one order and delivered separately, the withdrawal period runs from receipt of the last item.

To exercise the right of withdrawal, the consumer must notify LIGHTING DIY of their decision by means of a clear and unequivocal statement. The usual way to do so is by submitting a return request through the returns system available in the customer account. If the order was placed as a guest, the consumer may also notify their decision by letter sent by post or by email, sent to:

Consumers may use the model withdrawal form set out below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for the consumer to send their communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

The consumer must return the goods to LIGHTING DIY, at the above address, without undue delay and in any event no later than 14 calendar days from the day on which they communicate their decision to withdraw. The deadline is met if the consumer sends back the goods before the period of 14 days has expired.

The consumer bears the direct cost of returning the goods, unless otherwise expressly agreed or where the return is due to an error attributable to LIGHTING DIY.

Because LIGHTING DIY works with many manufacturers and artisans, products may show slight variations in colour or shape between orders, without affecting their safety or functionality.

If LIGHTING DIY makes an error in an order, the company undertakes to send the correct product and collect the incorrect one at no cost to the customer. Such an error or any omission of items does not imply that the customer may return correctly supplied products, except where the reasons fall within the scope of these Terms and the applicable withdrawal rules.

12. Effects of withdrawal

If the consumer withdraws from the contract, LIGHTING DIY will reimburse all payments received from the consumer, including standard delivery costs (with the exception of any supplementary costs resulting from the consumer’s choice of a type of delivery other than the least expensive standard delivery offered), without undue delay and in any event not later than 14 days from the day on which LIGHTING DIY is informed of the consumer’s decision to withdraw.

LIGHTING DIY may withhold reimbursement until it has received the goods back or until the consumer has supplied evidence of having sent back the goods, whichever is the earliest.

Reimbursement will be made using the same means of payment as used for the initial transaction, unless expressly agreed otherwise; in any event, the consumer will not incur any fees as a result of such reimbursement.

The consumer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

13. Exceptions to the right of withdrawal

In accordance with applicable EU and national consumer law, the right of withdrawal does not apply, among others, to contracts relating to:

  • Sales to professionals, distributors and shops, or to customers holding a professional account activated by GRUPO ILUMINABLE S.L. For such professional accounts, returns are not accepted except in case of factory defects or damage in transit. Exchanges of products are not accepted.
  • The supply of goods or services for which the price depends on fluctuations in the financial market which cannot be controlled by the trader and which may occur within the withdrawal period.
  • The supply of luminaires and plaster spotlights designed and manufactured to order in Barcelona. Returns of such products are not accepted, except where required by mandatory legal provisions (for example, in case of lack of conformity).
  • The supply of goods made to the consumer’s specifications or clearly personalised, including but not limited to: plaster spotlights and wall lights; decorative electrical cable cut to length on request; decorative flexible tubing for surface installation cut to length on request; blown glass globes and lampshades made to order; polyethylene and plastic globes made or ordered specifically for the customer; painted or custom-finished items and any other product manufactured expressly for the customer.
  • Items made of raw brass. Raw brass products may present small marks, scratches or imperfections inherent to the material and manufacturing process. Returns of brass items for this reason will not be accepted.
  • Returns of linear garlands, light curtains, light nets and light cascades once the Christmas period has passed, as these are seasonal products.
  • The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and were unsealed after delivery.
  • The supply of goods which, after delivery and by their nature, are inseparably mixed with other items.

14. Professional accounts

LIGHTING DIY offers professional accounts with special discounts, reserved solely for companies directly related to lighting, decoration or interior design. Accounts will not be activated for companies whose activities are unrelated to these sectors.

To activate a professional account, the company must clearly prove its professional activity by providing an official document (such as a company registration certificate or VAT number).

For professional accounts, returns are not accepted unless the product is defective or arrives damaged. In such cases, the applicable guarantee and transport rules will apply.

LIGHTING DIY reserves the right to suspend or cancel a professional account in case of misuse or breach of these Terms.

15. Discount coupons

LIGHTING DIY may issue discount coupons as part of promotions and marketing campaigns. Unless expressly stated otherwise, discount coupons are not cumulative with each other or with other offers. The customer may only use one coupon or benefit from one promotion per order.

For professional accounts, discount coupons do not apply, as such accounts already benefit from special commercial conditions.

16. Legal guarantees

Products sold by LIGHTING DIY are covered by the legal guarantee of conformity provided for in Directive (EU) 2019/771 on certain aspects concerning contracts for the sale of goods, as implemented in the consumer protection laws of each EU Member State.

For consumers in the European Union, the minimum legal guarantee period is 2 years from delivery. If the mandatory law of the consumer’s country of residence provides for a longer guarantee period, that longer period will apply.

In case of lack of conformity, the consumer is entitled, free of charge, to have the goods brought into conformity by repair or replacement, or, where appropriate, to a price reduction or termination of the contract, under the conditions laid down by applicable law.

The guarantee does not cover defects or damage resulting from improper use, negligence, impacts, incorrect installation or assembly, modifications to the product, or normal wear and tear.

LIGHTING DIY is not obliged to indemnify the user or third parties for indirect consequences of the use of the products, such as loss of profit, loss of business or loss of data, without prejudice to any mandatory rights under applicable product liability rules.

17. Product names

LIGHTING DIY sells products manufactured in-house as well as products sourced from multiple suppliers. The commercial name used on the Website may sometimes differ from the name appearing on the packaging, without affecting the actual product or its specifications.

18. Intellectual and industrial property

All content on the Website, including product descriptions, texts, images, trademarks, logos, buttons, software files, colour combinations, as well as the structure, selection, arrangement and presentation of such content, is protected by Spanish, EU and international intellectual and industrial property laws.

Access to the Website does not imply any waiver, transfer or assignment, in whole or in part, of any intellectual or industrial property rights. Any reproduction (except for temporary downloading for personal use), copying, distribution, reuse, exploitation, creation of derivative works, transmission, modification, assignment or any other use of all or part of the content without prior written authorisation from GRUPO ILUMINABLE S.L. is strictly prohibited.

The user undertakes to use the content in a diligent, correct and lawful manner and, in particular, to refrain from removing or altering any copyright notices, trademarks or other rights notices included in the content.

The domain lightingdiy.com is owned by GRUPO ILUMINABLE S.L. and may not be used in connection with products or services not belonging to GRUPO ILUMINABLE S.L., or in any manner likely to cause confusion among customers or to discredit the company.

19. Data protection (GDPR)

GRUPO ILUMINABLE S.L. is the controller of the personal data collected through the Website, in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and applicable national data protection laws.

Personal data are processed, in particular, for the following purposes:

  • managing user accounts and authentication;
  • processing, delivering and invoicing orders;
  • providing customer service and handling complaints;
  • complying with legal and tax obligations;
  • sending commercial communications by email, where the user has given consent or where permitted by law.

The legal bases for processing are, as applicable, the performance of a contract, the fulfilment of legal obligations, the legitimate interests of GRUPO ILUMINABLE S.L. and/or the data subject’s consent.

Personal data may be shared with third-party service providers (carriers, payment providers, hosting providers, email service providers, etc.) strictly to the extent necessary for the purposes described above.

Data subjects have the right to request access to, rectification or erasure of their personal data, restriction of processing, data portability and to object to processing, under the conditions laid down in the GDPR.

22. Out-of-court dispute resolution (ADR) and ODR platform

In the event of a dispute, consumers should first contact LIGHTING DIY at support@lightingdiy.com so that an amicable solution can be sought.

23. Applicable law and jurisdiction

These Terms and any contracts concluded via the Website are governed by Spanish law, without prejudice to the mandatory consumer protection provisions of the law of the EU Member State in which the consumer resides, in accordance with Regulation (EC) No 593/2008 (“Rome I”).

Any dispute relating to the interpretation, validity or performance of these Terms which cannot be resolved amicably may be submitted to the courts of Barcelona, Spain, without prejudice to the consumer’s right to bring proceedings before the courts of their habitual residence in the EU, as provided by applicable EU jurisdiction rules.
